In this sense the scene is not necessarily portrayed in an inaccurate manner; however, though it is implied that the desire for Katsumoto to commit seppuku was voluntary, given the fact he has been arrested also implies a sense that this seppuku is an act of punishment. Because the samurai were tamed and slowly faded during the Tokugawa period to sustain peace, ninja also gradually faded and were replaced by other agents.
However during the Meiji period, the image of ninja and its legends became popular, even today. In reality, only the senior advisers had the privilege to seeing the emperor and certainly, without an invitation no one was allowed to see the emperor like how Katsumoto.
